Re-use of Public Sector Information

The Food Safety Authority of Ireland (FSAI) is subject to the European Communities (Re-use of Public Sector Information) Regulations 2005 (S.I. No. 279 of 2005). The Regulations are available at www.psi.gov.ie.

Policy Statement on Release of Data

Information posted on this website may be downloaded and re-used free of charge without application with the following exceptions:

  • Photographs and artwork of any kind;
  • Brochures, leaflets or other documents whose author is not the FSAI. These items should include a logo or information about the author – for example, the report on the Investigation into levels of dioxins, furans, polychlorinated biphenyls and brominated flame retardants in fishery produce in Ireland is included on this website for public information purposes – this report was printed by the Marine Institute, as part of the “Marine Environment and Health Series”, for which the Marine Institute retains the copyright;
  • Any other documents/information in respect of which third parties hold intellectual property rights, including copyright.

The application must be for the release of documents for re-use and must state clearly that the request is for the re-use of public sector information. The FSAI’s Freedom of Information manual includes classes of data/records held by the Authority. Please refer to our section on Freedom of Information for details.

The FSAI will only supply data covered by the Regulations in pre-existing format or language.

As well as data protected by intellectual property rights, the Regulations do not provide for the release of personal data or information protected under the Freedom of Information Act. The Regulations do not permit the release of information in a manner that is otherwise prohibited by law.

The FSAI is not obliged by the Regulations to release documents for re-use. However, any information released will be subject to terms and conditions of the latest PSI licence available at www.psi.gov.ie/ and such other terms and conditions as the FSAI deem appropriate.

The FSAI is not liable for any loss or liability associated with the re-use of information and does not certify that the information is up-to-date or error free. The FSAI does not authorise any user to have exclusive rights to re-use the information.

Charges

Charges may apply for information which is released. Full details of any charges will be given to the applicant before the information is released.

Re-Use of Public Sector Information

The European Communities (Re-Use of Public Sector) Regulations 2005 (S.I. No. 279/2005) provide a statutory basis for the re-use by individuals and organisations of existing information held by public sector bodies.

The European Communities (Re-Use of Public Sector Information) Regulations 2005 (as amended by S.I. 103/2008 and S.I. 525/2015) (the PSI Regulations) affect how information may be re-used, once it is legitimately accessed, by placing obligations on the public sector to the benefit of re-users.

The PSI Regulations provide for the re-use of information held by public sector bodies. It is important to note, however, that the PSI Regulations

  • do not create any new rights of access to information
  • do not circumscribe existing regimes in respect of copyright or intellectual property
  • do not circumscribe the protection of personal data or Freedom of Information (FOI) legislation
  • do not permit the release of information in a manner that is otherwise prohibited by law
